1. About Avidlee Books

Avidlee Books is an audiobook platform for the avid reader. We sell narrated audiobooks — public-domain classics that we curate, as well as original titles uploaded by independent authors — and we bring those books to life with AI-generated scene paintings and short films you can watch while you listen.

2. Accounts & eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and to purchase audiobooks on Avidlee Books. By using the Services you represent and warrant that you meet this requirement.

• You are responsible for keeping your account credentials secret and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when registering and to keep that information up to date.
• You may sign in with an email and password or with Google. Either way, the same account, library, and history apply.
• We may suspend or close any account that we reasonably believe is being used in violation of these Terms or applicable law.

3. Purchases, pricing & payments

Prices for each audiobook are displayed in U.S. Dollars on the product page. By tapping “Buy” and completing checkout, you authorize Avidlee Books to charge your selected payment method for the displayed amount plus any applicable taxes.

• Payment processor. Payments are processed by PayPal, including PayPal's Debit/Credit card flow. Avidlee Books does not store your full card number.
• Confirmation. A purchase is final when PayPal returns a COMPLETED status; the book then appears in your My Shelf library immediately.
• Duplicate purchases. Our system blocks duplicate purchases of the same audiobook for the same account.
• Taxes. You are responsible for any sales or use tax applicable to your purchase under the law of your jurisdiction.

4. Refund policy

Because audiobooks are digital goods delivered immediately upon purchase, all sales are final. We will, however, consider a refund in good faith if any of the following applies:

• You were charged twice for the same audiobook due to a technical error.
• The audio file fails to load, fails to play, or is severely corrupted, and our support team is unable to restore access within a reasonable time.
• You report unauthorized use of your payment method.

To request a refund, email brandon.davis509@outlook.com within 14 days of purchase with your PayPal order ID and the book title. Approved refunds are returned to the original payment method via PayPal.

5. Your license to listen

When you buy an audiobook on Avidlee Books, you are not buying ownership of the work itself. Instead, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to:

• Stream and listen to the audiobook through the Avidlee Books player from any device you sign in on, for personal, non-commercial use.
• Generate AI scenes (narration, paintings, short films) for that audiobook through the AI features built into the player.
• Re-open AI scenes you previously generated from your library.

You may not redistribute, resell, mirror, broadcast publicly, or use AI-generated outputs from the Services to train other AI systems. Public-domain classics remain in the public domain; what is licensed to you is the specific narration, art, and Avidlee Books experience around them.

6. Indie authors & 70/30 royalty

Independent authors may apply to publish original audiobooks on Avidlee Books. By submitting an application and uploading audio, you agree to the following.

Royalty split

• 70% of net revenue from each sale of your title is owed to you as a royalty.
• 30% of net revenue is retained by Avidlee Books to cover hosting, AI generation costs, payment processing fees, and platform operations.
• “Net revenue” means the price the customer pays after PayPal's processing fees and any refunds, chargebacks, or taxes.
• We report your earnings and pending payout on the Author Dashboard. Payouts are batched and remitted on request once an author's pending balance exceeds the threshold listed in your dashboard.

Author content warranties

By uploading audio, cover art, descriptions, or scene prompts to Avidlee Books, you represent and warrant that:

• You own all rights in the work, or you have all necessary licenses to upload it and to grant us the rights described below.
• Your content does not infringe any third party's copyright, trademark, publicity, privacy, or other right.
• Your content is not obscene, hateful, defamatory, or otherwise unlawful, and complies with our Acceptable Use policy.
• Your audio is your own recording (or a recording you have a license to distribute), not a re-upload of someone else's published audiobook.

License you grant Avidlee Books

You grant Avidlee Books a worldwide, non-exclusive, royalty-bearing (per Section 6 above) license to host, encode, stream, display, distribute, and promote your audiobook, cover art, description, and scene metadata through the Services for the duration of your account. You may remove your title at any time by emailing us; once removed, no new purchases will be permitted, but existing buyers retain access to what they already paid for.

Admin review

Avidlee Books reviews every author application and every uploaded audiobook before they appear in the catalog. We may decline, remove, or unpublish content at our reasonable discretion — for example, if it violates these Terms, infringes third-party rights, or is otherwise unsuitable for the platform.

7. AI scenes, paintings & films

The AI features on Avidlee Books are powered by third-party AI service providers (currently OpenAI, via the Emergent integrations platform). When you generate a scene, your text prompt is sent to the provider, which returns a narration audio file, painted image, or short cinematic film.

• AI-generated content is provided as-is. We cannot guarantee perfect accuracy, style consistency, or freedom from artifacts. Sora 2 short films, in particular, may take several minutes to render.
• You receive a personal, non-commercial license to enjoy the AI content you generate within the Avidlee Books player. You may not redistribute, resell, or use the AI output to train other AI systems.
• You will not submit prompts that request sexual content involving minors, real-world non-public-figure identification, hate speech, or other content prohibited by the underlying AI provider's usage policies.
• Avidlee Books is not responsible for any content the AI generates from your prompts; you remain responsible for the prompts you submit.

8. Acceptable use

You agree not to use the Services to:

• Violate any applicable law or regulation.
• Infringe or misappropriate any third party's intellectual property, privacy, or publicity rights.
• Upload, generate, or distribute content that is illegal, infringing, defamatory, harassing, sexually explicit involving minors, or that incites violence or hatred.
• Attempt to bypass the payment flow, share your account credentials, or scrape, mirror, or copy our catalog or AI-generated outputs at scale.
• Interfere with, disable, or attempt to gain unauthorized access to any part of the Services, our servers, or third-party services we depend on (PayPal, OpenAI, Google).
• Use the Services to train, fine-tune, or evaluate any machine learning model.

9. Intellectual property & DMCA

The Avidlee Books brand, logo, site design, written copy, and software are owned by Avidlee Books and are protected by copyright, trademark, and other intellectual property laws. Public-domain works featured on Avidlee Books remain in the public domain; our specific narrations, AI scene art, and presentation are not.

If you believe content on Avidlee Books infringes your copyright, please send a DMCA notice to brandon.davis509@outlook.com including: (a) your contact information; (b) a description of the copyrighted work; (c) the URL of the allegedly infringing material on Avidlee Books; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement under penalty of perjury that your notice is accurate and that you are authorized to act on behalf of the rights holder; and (f) your physical or electronic signature.

10. Disclaimers

The Services and all content offered through them are provided “as is” and “as available”, without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Avidlee Books disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI output, and uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, Avidlee Books and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising out of these Terms or your use of the Services will not exceed the greater of (a) the total amounts you have paid to Avidlee Books in the twelve (12) months before the event giving rise to the claim, or (b) US $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless Avidlee Books from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content you submit to the Services (including any audiobook you upload as an indie author or any AI prompt you submit); (b) your breach of these Terms; or (c) your violation of any law or third-party right.

13. Termination

You may close your account at any time by contacting us at brandon.davis509@outlook.com. We may suspend or terminate your account or your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if continued provision of the Services to you would expose Avidlee Books to legal or operational risk.

Sections that by their nature should survive termination — including license terms for purchases already made, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles. You and Avidlee Books agree to submit to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina, for the resolution of any dispute arising out of or related to these Terms or the Services, except where prohibited by applicable consumer-protection law in your jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be indicated by an updated “Last updated” date at the top of this page. If we make material changes, we will notify you either by prominently posting a notice on the site or by emailing the address associated with your account. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
